In one of your answers to a poster (June 2009), you stated that the Breach Penalty was USD $500 to $2000. My contract, which I signed in March 2009 says USD $300 to $800 or the equivalent of three to ten times my salary, in RMB.

Since I currently stand to collect on this Breach Penalty, and the university I am at is agreeing to pay me this penalty, which is correct? My contract's stated amount, or the one you quoted?

The official SAFEA contract does clearly state a breach penalty range of $500 to $2,000 on page 4 of the English version, and that's predetermined by the SAFEA (the amount is not arbitrarily established and then filled in by the school). However, the SAFEA contract can be modified by the contract addendum and it's the amount written in the addendum that will prevail.

If your addendum states $300 to $800 then that's the range you have to negotiate with.
