Employer Is Withholding Alien Work Permit

Postby sar1906 » Thu Jan 31, 2013 5:54 pm

Hello,

My name is Sebastian. I worked in China this past year with a private training school in Wuhan. I came into China at the age of 23 with little experience. As I understand it, this made it extremely difficult to get the proper working documents. Eventually, the employer acquired the alien work permit and residence permit for me to work legally in the country.

Fast forward to the end of the first year contract. I notify the employer I am leaving, she seems to be fine about it, grants permission to write a letter of recommendation with official company stamp, all appears to be well. From what the new school told me, all I needed was this letter of recommendation. I return home to the U.S. for a couple weeks, visiting family, etc.

I return to China, expecting to have a paycheck in the bank (the last one from the previous employer), but I got nothing.

Long story short: I was working on an alien work permit and residence permit with a private training school. The boss is angry because it cost her a lot of money to get my working papers, and I left at the end of the contract for another school. She is withholding my final paycheck and the alien work permit.

The new school needs these papers to get the new working documents, but my previous employer is absolutely refusing to release them. At this point, I just want to stay in the country legally.

What can I do?

The only real recourse you have is to contact the PSB local to where the school is. The Letter of Recommendation/Release is mandatory.

Use the PSB to pressure her. That really is your only hope.

I wish you well.

Okay, this is what I will attempt to do.

Thank you.
